“A Delaware man who says he awoke from a colonoscopy to find he was wearing pink women’s underwear is suing a surgical center.

Andrew Walls of Dover filed the civil lawsuit in New Castle County Superior Court against the Delaware Surgery Center on Friday. It seeks unspecified damages.

A spokeswoman for the surgery center declined to comment on the case.

Walls’ attorney, Gary Nitsche, wrote in the lawsuit that his client suffered severe emotional stress and mental anguish after waking up from a colonoscopy on Oct. 12, 2012, to find he was wearing pink women’s underwear. Walls says he had not been wearing the underwear before being given anesthesia for the procedure.” *

  1. so after reading an article on Buzzfeed it says that this man worked at the medical place where he had the colonoscopy done, and his coworkers did this to him as sort of a prank. Somehow this lead to his dismissal from his job. That changes the story quite a bit.

  2. Ok, I believe this man has not only every right to sue but a duty to sue. It seems to me the implications of him waking up after a colonoscopy in pink panties would be for him to believe that he was sexually assaulted. Now if he was or wasn’t assaulted he will not be able to remember, but what other message could those underware have sent? I hope to god they find out who did this to him, and they pay. As a nurse I am sickened by this, people put their complete trust in us every day to protect them while at their most vulnerable. How much more vulnerable could a man be than during a colonoscopy?
